Article 1 - Duration of the stay: The tenant who signs this contract for a fixed period may not under any circumstances claim any right to remain in the premises at the end of the stay.
Article 2 - conclusion of the contract (deposit and balance): The reservation becomes effective once the tenant has sent the owner the total amount of the rental in two payments:
- a deposit of at least 25% of the total rental price,
- the balance of the stay which will be cashed after the day of arrival in the premises.
The lease concluded between the parties to this deed may in no case benefit even partially to third parties, natural or legal persons, except with the written agreement of the owner.
Any breach of this last paragraph may result in the immediate termination of the rental agreement to the detriment of the Tenant, with the proceeds of the rental agreement remaining with the Landlord.
Article 3 - No withdrawal: For bookings made by post, telephone or internet, the hirer does not benefit from the withdrawal period, in accordance with article L121-20-4 of the French Consumer Code relating in particular to the provision of accommodation services supplied on a specific date or at a specific time.
Article 4 - Cancellation by the tenant: Any cancellation must be notified by registered letter to the owner.
Cancellation before arrival :
The deposit is returned to the tenant if the cancellation occurs more than 7 days before the date of arrival in the premises. In case of cancellation between 24 hours and 7 days, 50% of the total amount is due. In the last 24 hours, the totality of the stay remains due.
If the tenant does not show up within 24 hours after the arrival date indicated on the contract, the present contract becomes null and void and the owner can dispose of his gîte. The payments made also remain the property of the owner.
If the stay is shortened, the price of the rental remains with the owner. No refund will be made.
Article 5 - Cancellation by the owner: the owner will pay the tenant the full amount paid.
Article 6 - Arrival: the tenant must arrive on the day and at the time indicated on the present contract. In case of late or delayed arrival, the tenant must inform the owner.
Article 7 - Inventory of fixtures: An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure of the gite. This inventory is the only reference in case of dispute concerning the state of the premises.
The state of cleanliness of the gîte on the Tenant's arrival must be noted in the inventory of fixtures. The cleaning of the premises is the responsibility of the Tenant during the rental period and before departure, depending on the option chosen. The amount of any cleaning costs is established on the basis of the calculation mentioned in the description sheet.
Article 8 - Security deposit: On the arrival of the tenant, a security deposit of 500€ is requested by the owner. After the inventory of fixtures has been established, this deposit is returned, less the cost of repairing the premises if any damage has been found.
A deposit of 75€ is required for tenants who have not chosen the cleaning option.
In case of early departure (before the time mentioned on the present contract) preventing the establishment of the inventory of fixtures on the day of the tenant's departure, the deposit is returned by the owner within a period not exceeding one week.
Article 9 - Use of the premises: The Tenant shall ensure the peaceful nature of the rental and use it in accordance with the purpose of the premises.
Article 10 - capacity: The present contract is established for a maximum capacity of 4 persons. If the number of tenants exceeds the capacity, the owner can refuse the additional persons. Any modification or breach of contract will be considered at the client's initiative.
Article 11 - Reception of animals: Dogs must be kept on a leash on the site unless they are sociable with other animals.
Article 12 - Insurance: The Tenant is responsible for all damage caused by him. He must be insured by a holiday insurance contract for these different risks.
Article 13 - Payment of charges: At the end of the stay, the tenant must pay to the owner, the charges not included in the price, if any.
The amount is calculated on the basis of the calculation mentioned in the present contract and in the description sheet and a receipt is given by the owner.
Article 14 - Disputes. In the event of a dispute and after all amicable discussions have been exhausted, the courts of the place where the rental is located shall have exclusive jurisdiction.
